1. Acceptance of Terms

By accessing and using the Balaton Yacht Charter platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Balaton Yacht Charter is a platform that connects boat owners with individuals seeking to rent boats on Lake Balaton. We facilitate bookings but are not the owner or operator of the boats listed on our platform.

3. User Accounts

3.1 Registration

To use certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and for maintaining the confidentiality of your account. You agree not to disclose your password to any third party and to take sole responsibility for activities that occur under your account.

4. Booking and Payment

4.1 Booking Process

When you make a booking through our platform, you enter into a direct contractual relationship with the boat owner. We facilitate this transaction but are not a party to the rental agreement.

4.2 Payment Terms

Payment is processed through our secure payment system. Full payment is required at the time of booking unless otherwise specified. All prices are in Hungarian Forint (HUF) and include applicable taxes.

4.3 Cancellation Policy

• Free cancellation up to 48 hours before the rental start time
• 50% refund for cancellations between 24-48 hours before rental
• No refund for cancellations within 24 hours of rental start time
• Weather-related cancellations may be eligible for full refund at our discretion

5. User Responsibilities

5.1 Renters

As a renter, you agree to:

• Possess valid boating licenses as required by Hungarian law
• Operate the boat safely and in accordance with all applicable laws and regulations
• Return the boat in the same condition as received
• Report any damage or incidents immediately
• Pay for any damage caused during the rental period

5.2 Boat Owners

As a boat owner, you agree to:

• Provide accurate descriptions and photos of your boat
• Ensure your boat meets all safety requirements and regulations
• Maintain valid insurance and registration
• Provide the boat in clean, safe, and working condition
• Be available for check-in and check-out procedures

6. Safety and Insurance

6.1 Safety Requirements

All boats must comply with Hungarian maritime safety regulations. Renters must follow all safety guidelines provided by boat owners and applicable laws.

6.2 Insurance

Boat owners must maintain adequate insurance coverage. Renters are advised to check their personal insurance policies for coverage during boat rentals.

7. Prohibited Uses

You may not use our Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information

8. Limitation of Liability

Balaton Yacht Charter acts as an intermediary platform and is not liable for any damages, injuries, or losses that may occur during boat rentals. Our liability is limited to the maximum extent permitted by law.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Balaton Yacht Charter and its licensors. The Service is protected by copyright, trademark, and other laws.

10. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

11. Dispute Resolution

Any disputes arising from the use of our Service will be resolved through binding arbitration in accordance with Hungarian law. The arbitration will take place in Siófok, Hungary.

12. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our platform. Continued use of the Service after such modifications constitutes acceptance of the updated terms.

13. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

14. Governing Law

These Terms shall be interpreted and governed by the laws of Hungary, without regard to its conflict of law provisions.
